The mobile application pureoptimum and website www.pureoptimum.com are owned and operated by pureoptimum.com, a company duly incorporated under the provisions of the Companies Act, 2013 (hereinafter referred to as “pureoptimum” or “We” or “Our” or “Us” or “Company”). The domain name and the mobile application are collectively referred to as the “Website”.

The User, by placing an order either through the pureoptimum App or Website, is deemed to have consented to these terms and conditions. At its sole discretion, pureoptimum is entitled to change or modify the terms and conditions from time to time, without obligation to notify the User. The User should review these terms and conditions periodically.

GENERAL

This document is an electronic record generated by a computer system in terms of the Information Technology Act, 2000 and applicable rules, and does not require physical or digital signatures.

This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which requires publishing the rules and regulations, privacy policy, and Terms of Service for access or usage of www.pureoptimum.com or the web-based application (“App”).

OWNERSHIP

This App and the Website are owned and provided by pureoptimum. By registering as a Subscriber/User, you are granted a limited, revocable, non-exclusive license to use the Website and the App. pureoptimum may terminate this license at any time with or without reason or notice. The content on the Website and the App is protected under applicable laws of India.

TERMS AND CONDITIONS

These terms and conditions together with the privacy policy form a valid and legally enforceable contract between the User and pureoptimum under the Indian Contract Act, 1872. In case of inconsistency, these terms and conditions prevail over the privacy policy.

SHIPPING AND DELIVERY

• The sale is deemed concluded when the sale invoice is generated by pureoptimum, irrespective of whether the consignment has been delivered to the User’s location.
• After invoice generation, pureoptimum will deliver the products to the specified location via own delivery personnel/third parties/other modes.
• Applicable taxes, levies, surcharges, and shipping fees (which may vary by factors like order value and destination) will apply.
• Typical delivery TAT is up to 6 hours for hyperlocal models (where applicable) and otherwise as communicated at checkout; actual times depend on traffic, availability, destination, and other exigencies.
• The User is solely responsible for providing the correct delivery address before placing the order. If the address is incorrect, pureoptimum is not responsible to resend to the modified address.
• In case of delayed delivery, notify pureoptimum; we will investigate, but we are not liable for loss/damage arising from such delays.
• Coupons should be redeemed within 15 days of receipt unless otherwise specified.

RETURN, REFUND AND CANCELLATION POLICY

• If the User receives an inappropriate or damaged product, pureoptimum will refund the product price and delivery fee upon return of the item in satisfactory condition.
• For replacements, pureoptimum will dispatch the same product subject to stock availability when the returned item is received.
• The User must return damaged/inappropriate products within 2 days from receipt. Refunds are processed within 7 working days after the product is received and verified.
• If no communication is received within 7 days of delivery, it is presumed the order is acceptable and further claims may not be entertained.
• If the User cancels because the item is out of stock/unavailable or not delivered within the stipulated timeline, pureoptimum will refund within 21 working days of the original payment.
• Once an order is shipped/In-Transit/Delivered, cancellation will not be entertained. After successful delivery, pureoptimum is not liable for subsequent loss/damage/theft.
• pureoptimum may use third-party logistics providers. These are independent of pureoptimum. Delays/damages attributable to such entities must be claimed with them; do not accept visibly damaged or tampered parcels—return to courier and inform pureoptimum immediately.

Refund/Replacement will not be initiated in the following cases:

• Evaporation/leakage below 25% of total quantity.
• Product seal is broken or product used.
• Damage due to mishandling or misuse by the buyer.

PRICING

• pureoptimum may run promotions/discounts/concessions at its discretion and may modify/terminate them without notice.
• Payments may be made via COD (where available), cards, net banking, UPI, and other gateways permitted on the portal. Additional delivery/COD charges may apply.
• We strive to display correct MRPs. If there is a variance, the User will be informed of updated MRP during processing and prior to order acceptance.
• All statutory taxes and levies are applied to the invoice.

INDEMNITY

The User agrees to indemnify and hold harmless pureoptimum, its vendors, officers, employees, and agents from any losses, liabilities, claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising from the User’s breach or non-performance of these terms, or third-party claims arising from the User’s material/website use.

pureoptimum’s aggregate liability is limited to the amount paid by the User for the relevant product/service. Limitations apply to the maximum extent permitted by law.

GOVERNING LAW & JURISDICTION

These terms are governed by the laws of India. Courts at Ghaziabad, Uttar Pradesh, shall have exclusive jurisdiction.

REFUSAL OF SERVICE

pureoptimum may refuse service to anyone at any time. Services may be suspended or discontinued if systems are affected by viruses/bugs/technical issues. Users should notify pureoptimum upon discovering such issues. pureoptimum bears no liability for losses due to such issues.

LIMITATION OF LIABILITY

Even in cases of proven liability, pureoptimum’s liability will not exceed the fee paid for the product/service. No liability for consequential, indirect, incidental, special, or punitive damages.

IT SECURITY

Third-party links may appear on the Website/App. pureoptimum has no control over their content/accuracy. Users access them at their own risk. pureoptimum assumes no liability for malware/viruses affecting the User’s systems. If dissatisfied, discontinue using the Website/App.

SEVERABILITY

If any provision is held void/unenforceable, the remaining provisions remain valid and enforceable.

ELIGIBILITY

Only persons competent to contract under the Indian Contract Act, 1872, may use the services. Minors may use the services through a parent/natural guardian.

ONLINE SECURITY

pureoptimum implements security measures as required by law. Users shall not attempt unauthorized access, probe vulnerabilities, overload or disrupt the Website/App. Violations may be investigated and reported to authorities.

CHANGES OF SERVICE AND CANCELLATION

pureoptimum may improve/change/cancel services at any time. Users may cancel their use of services at any time.

ASSIGNMENT

Users may not assign/transfer rights under these terms. pureoptimum may assign/transfer its rights.

NOTICES

pureoptimum may serve notices via email or on-site notifications. Users may send notices to info@pureoptimum.com.

DISCLAIMER OF WARRANTY

Services are provided “as is” without warranties of any kind (express/implied/statutory), including merchantability, fitness for a particular purpose, non-infringement, or title. pureoptimum does not warrant uninterrupted or error-free service.

CODE OF CONDUCT

Users shall not: sublicense/transfer rights to the Website/App; make/store unauthorized copies; build competing services; modify/translate derivative works without permission; impersonate; upload infringing/privacy-violating/defamatory/hate/obscene content; threaten national integrity; or engage in conduct disrupting Website/App functionality or facilitating criminal offenses.

FORCE MAJEURE

Neither party is liable for failure/delay due to events beyond reasonable control (Acts of God, war, civil unrest, terrorism, strikes, power failures, etc.).

BREACH OF TERMS

In the event of breach, pureoptimum may seek compensatory damages and recovery of legal costs/attorney fees.

TERMINATION

pureoptimum may terminate access due to breach, economic unviability, or technological issues rendering operations unfeasible.

ONLINE STORE TERMS

You represent you are the age of majority or have parental consent for minors. Do not use our products/services for unlawful purposes; do not transmit malicious code. Breach will result in immediate termination.

GENERAL CONDITIONS

We may refuse service to anyone. Non-card content may be transmitted unencrypted across networks; card data is always encrypted. Do not reproduce/exploit Service without written permission.

ACCURACY, COMPLETENESS AND TIMELINESS

Materials may not be accurate/complete/current; use primary sources where needed. We may modify content without obligation to update.

MODIFICATIONS TO SERVICE AND PRICES

Prices and services may change without notice; we are not liable for such changes.

PRODUCTS OR SERVICES

Some items may be available online only, in limited quantities, and subject to our Return Policy. We strive to display colors/images accurately but cannot guarantee monitor accuracy. We may limit sales/quantities and discontinue products.

ACCURACY OF BILLING AND ACCOUNT INFORMATION

We may refuse or limit orders (by account/card/address). Keep your account and payment info updated.

OPTIONAL TOOLS & THIRD-PARTY LINKS

Optional third-party tools/links are provided “as is”; use at your own risk. Review their policies before engaging. We are not responsible for third-party content or transactions.

To the fullest extent permitted by law, pureoptimum and its affiliates are not liable for indirect/incidental/special/consequential damages. In certain jurisdictions, liability is limited to the maximum extent allowed.

INDEMNIFICATION

You agree to indemnify pureoptimum and affiliates against claims arising from your breach of these Terms or violation of law/third-party rights.

SEVERABILITY

If any provision is unlawful/void/unenforceable, the remainder remains effective.

TERMINATION

Obligations incurred prior to termination survive termination. We may terminate without notice if you breach the Terms.

ENTIRE AGREEMENT

These Terms and posted policies constitute the entire agreement and supersede prior understandings.

CHANGES TO TERMS

We may update these Terms at any time by posting changes. Continued use constitutes acceptance.
